Terms and Conditions

The general terms that apply when HTK Scaffolding Ltd erects, adapts, hires out, inspects and dismantles scaffolding for homeowners, contractors and commercial clients.

About these terms

These terms apply to every scaffold we supply. Your written quotation, and any hire terms attached to it, sit alongside these terms. If anything in your quotation is different from what is written here, your quotation wins.

By accepting a quotation, you agree to that quotation and to these terms. Some parts only apply to homeowners (consumers) and some only to businesses. We say where that is the case.

Your quotation

  • Every quotation is fixed for the scaffold described in it, based on the information and photographs we were given or what we saw on a site visit.
  • Each quotation shows how long it remains valid. confirm validity period used on quotes
  • If the job turns out to be different from what we were told, for example a different height, extra elevations or access we could not see, we will explain what has changed and agree a revised price with you before doing the extra work.

What is included in the price

Your quotation lists exactly what is included. Unless it says otherwise, the price covers:

  • delivery, erection and final dismantling of the scaffold described
  • the hire period shown on the quotation
  • a handover certificate when the scaffold is ready to use
  • risk assessment and method statement (RAMS) where needed

Items that are only included if the quotation says so include: extended hire, weekly inspections, pavement licence fees, sheeting, netting, alarms, loading bays, temporary roofs, beams, and any adaptations. confirm this list matches your standard quotation

Hire period and extended hire

The hire period included in your price starts on the day the scaffold is handed over and is shown on your quotation. confirm when the hire period starts and the standard length

If you need the scaffold for longer, please tell us before the hire period ends. Extended hire is charged at the weekly rate shown on your quotation. We will never add extended hire charges without having told you the rate first.

Inspections

By law, a scaffold in use must be inspected by a competent person before first use, at least every seven days, and after anything that could affect its safety, such as high winds or alterations. The person in control of the site is responsible for making sure this happens.

Your quotation shows whether we are carrying out weekly inspections for you and, if so, whether they are included in the price or charged per inspection. confirm weekly inspection charge and who normally inspects

Adaptations and extra work

Only our scaffolders may alter the scaffold. If you or your trades need a lift raised, boards moved, a loading bay added or anything else changed, please ask us. Adaptations are priced and agreed with you before we carry them out, using the rates on your quotation where they are shown. confirm how adaptations are priced

Pavement licences and permits

If any part of the scaffold stands on or over a public pavement or road, the council will usually require a licence. We will tell you if one is needed, apply for it where agreed, and explain the council fee and timescale before work starts. Your quotation shows whether the licence fee is included or passed on separately. confirm whether licence fees are passed on at cost or with an admin charge

Work cannot start on the highway until the licence has been granted. Council delays are outside our control, but we will keep you updated.

Your responsibilities

To keep everyone safe and the job on schedule, we ask you to:

  • give us clear, safe access to the areas where the scaffold is going on the agreed dates
  • get any permission needed from neighbours if the scaffold will stand on, overhang or be reached through their property
  • tell us about anything we cannot see, such as fragile roofs, conservatories, drains, cables or underground services
  • make sure nobody alters, removes or climbs on the scaffold other than for the agreed work, and keep it secure from unauthorised access
  • tell us straight away if the scaffold is damaged, moved, or anything looks wrong
  • make sure the required inspections take place if we are not carrying them out
  • keep the scaffold clear of rubbish and heavy loads beyond what was agreed

Dismantling and removal

Where we can, we book the removal date at the same time as the erection date. If your work finishes earlier or later, please let us know as soon as possible so we can rebook. confirm notice period needed to rebook a strike

Before we dismantle, please make sure the scaffold is clear of tools, materials and waste, and that we have the same safe access we had for erection.

Payment

Payment terms, including any deposit and when invoices are due, are shown on your quotation or invoice. payment terms missing: deposit, due dates, late payment

For business customers, we may charge interest and compensation on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

Our bank details are only ever sent on our invoices. We will never change them by email or text. If you receive a message asking you to pay a different account, call us on 07835 360988 before paying.

VAT

HTK Scaffolding Ltd is VAT registered (VAT number 463342010). Your quotation will say clearly whether prices include or exclude VAT. confirm how VAT is shown on quotes Where the construction industry VAT domestic reverse charge applies to a business customer, we will say so on the invoice.

Cancelling or changing a booking

Damage, loss and liability

We take care of your property and hold public liability and employers' liability insurance. We are responsible for loss or damage caused by our negligence or by breaking these terms.

We are not responsible for loss or damage caused by anyone altering or misusing the scaffold, by information you gave us that was wrong, or by events outside our reasonable control, such as severe weather.

You are responsible for scaffold materials lost, stolen or damaged while on your site, other than by us, unless your quotation says otherwise. confirm this matches your hire terms

For business customers, we are not liable for loss of profit, loss of business or indirect loss. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

If you are a homeowner

If you are a consumer, you have legal rights under the Consumer Rights Act 2015, including that our work will be carried out with reasonable care and skill. Nothing in these terms affects those rights. For advice, visit Citizens Advice.

Complaints

If something is not right, call us or email info@htkscaffolding.co.uk. A director will look into it and reply within five working days. confirm complaint response time

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute.
